PatentRatings® System

PatentRatings, LLC, an Ocean Tomo Company, has developed the first proven, market validated, software platform for objectively assessing patent quality, relative valuation, trends, and competitive analysis for patents, patent portfolios, and the strength of patent portfolio of companies. Our customizable data solutions deliver actionable data to companies, investors, bankers, attorneys and other intellectual property professionals and decision makers.

This patented platform and corresponding patent rating system uses advanced econometrics based algorithms applied to its proprietary database of entire US issued patent universe of over 7 million records. The results deliver an objective basis for determining the quality of individual patent, which allows for accurate analysis of portfolio of patents and predictability of any current or new patents that enables inventors, companies, investors and intellectual property professionals to assess quality and improve patent related decisions. The platform can provide the following information to the user on an automated basis, either individually or in a comprehensive report format. Examples of the statistical metrics include, but are not limited to:

  • IPQ® Score – Determination of patent quality utilizing our proprietary rating system.
  • Patent Exchange Value (PEV) – Delivers an assessment of patent value in relation to other patents.
  • Competitive Analysis – Determines and quantifies the degree of relevance between one or more patents or group of patents.
  • Chain of Title Analysis – Identifies missing or defective assignments, security interests and defects in the patent chain of title.
  • Inventor analysis and breakdown – Delivers a complete analytical breakdown of key inventors.
  • Classification Analysis – Identifies the major patent holders within any given SIC code.
  • Obsolescence Analysis – Determines the rate of obsolescence for areas of technology.
  • Life Expectancy – Delivers the statistical predictive life expectancy of patents.

IPQ® Scores [download sample report]

Intellectual property has become the cornerstone asset for many companies ranging from Fortune 500® companies to early stage venture backed start-ups. As a result, it has become more critical than ever that these companies maintain the ability to quickly assess and triage the quality and value of patents. In addition, larger companies are plagued with the problem of having to review thousands of patents simultaneously incurring significant costs associated with laborious subjective analysis.

The PatentRatings® system is the premier objective rating system for patent assessment across the entire universe of US issued patents. The rigorous econometrics-based platform enables companies to efficiently compare large or small numbers of patents, all by the same set of metrics and criteria in a completely automated fashion. The platform generates an IPQ® report, which delivers an immediate assessment of patent quality and other predictive actuarial data for each patent.

The report includes an IPQ® score that provides a simple, easy to understand yard-stick for measuring and comparing patent quality/value based on the cumulative characteristics of patents that make them statistically either more likely or less likely to produce economic returns. The IPQ® score provide the following:
  • An objective methodology for the comparison of patents for due diligence.
  • Corporate quality triage for large patent portfolios which enables better maintenance decisions.
  • Objective basis for active management of portfolio of patents
  • Comparison of patents across industries, sectors, and technologies.
  • Predict data regarding the expected life of an intellectual asset.
  • Competitive analysis and risk assessment

Patent Competitive Analysis

Historically, evaluating patent or group of patents in light of competition has been a cumbersome and expensive undertaking for related individuals and companies to assess owners of those patents which are strategic or closely related to their own patent portfolios for many reasons. These include the need to identify patents for acquisition, to find potential buyers for patents seeking to be sold, or to identify potential licensing partners.

The Relevance Engine that drives competitive analysis solves this dilemma as it quantifiably identifies the most relevant and strategically important patents to an individual patent or portfolio of patents. Leveraging its patented methodology, it utilizes a combination of sophisticated citation analysis and regression to enable the identification of potential IP acquisitions, acquirers and licensing partners. In combination with the PatentRatings® system, this enables the ability to both identify relevant patents, and to rank them by patent quality, value, and other appropriate metrics. These provide an objective basis for evaluating relevant patents, technologies and companies to:
  • Identify relevant patents in its target technology space
  • Rapidly identify a group of potential alliance partners or potential competitors
  • Degree of competitive pressure or openness in a given technology space
An example of the Relevance Engine output for U.S. Patent 5,436,960 (one of NTP patents) is depicted below. The relevancy analysis conducted based on the ‘960 patent revealed 51 patents with relevance scores greater than 0.1. Relevancy scores measure the probability that one or more patent would be cited as prior art against another patent. A list of the top 10 identified relevant patents is provided below:

Patent Due Diligence [download sample report]

Conducting due diligence and analysis on intellectual property and its owners remains a difficult and costly endeavor. Companies often face a difficult decision as to what resources to allocate towards conducting patent due diligence and analysis. The Patent Due Diligence Report (DDR) delivers a comprehensive analysis which enables companies to make an efficient and up front assessment on potential patent transactions. The report is actively utilized by companies seeking to buy or sell particular patents, investment firms and banks conducting due diligence on transactions, and IP law firms for the purpose of conducting an initial patent screen for their clients. Reports are available either individually, or through a monthly subscription service. This comprehensive patent review contains analysis and identification of essential factors which drive crucial decisions on patents. The report delivers analysis which includes the metrics, as described on page 3 for a single patent or portfolio of patents.
